Nowadays almost everyone carries a cellular telephone with them as they move from place to place throughout the day. Most cell phone plans have a text message component for which subscribers pay a fee for sending and receiving text messages. Recognizing that text message advertising is a direct and inexpensive way to reach consumers almost any time of the day or night, some businesses conduct telemarketing campaigns by sending hundreds or thousands of text messages to cellular telephone numbers of customers or potential customers simultaneously. Like autodialer telemarketing calls that leave pre-recorded voice mail messages, these advertising text messages are generally illegal under both state and federal law.
